    Statutory Nuisances (Hedgerows in Residential Areas) [H.L.]


     

    A

    Bill

    To

    Make Provision for Hedges to be a Statutory Nuisance.

     

    Be it enacted by the Queen's most excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

    1. -        (1). Section 79 of the Environmental Protection Act 1990 is amended as follows,

      (2) In subsection (1) (list of statutory nuisances), after paragraph (a) there is inserted

        '(aa) any hedgerow planted in such a manner as to be prejudicial to health or a nuisance:' 79 of the Environmental Act

      (3) In subsection (7)(Interpretation) after the definition of 'gas' there is inserted

        "hedgerow" means any hedge forming a boundary between two private dwellings;".

    2. This Act may be sited as the Statutory Nuisances (Hedgerows in Residential Areas) Act 2000.
